Is there a minimum amount of medical bills needed to pursue a personal injury lawsuit?
The other day, a client asked if there’s a minimum amount of medical bills they would need to have to pursue a personal injury case in Orlando. There’s no exact amount of medical bills or a minimum amount that you need to pursue a personal injury case in Orlando. As with anything, however, one of the factors that the insurance companies, corporations, and then juries will evaluate and assess in a personal injury case is the amount of medical bills. That’s one of the things that they are asked to award: if they’re reasonable, related, and necessary as a result of someone else’s fault.
In addition, if it’s a car accident case, we have in Florida what’s called personal injury protection— no-fault insurance that can cover up to $10,000 of the initial medical treatment. Under most circumstances, any medical bills below 10,000 would be paid for by that personal injury protection insurance. While there’s no exact or minimum amount of medical bills needed to pursue a personal injury case, it’s one of the factors that the insurance companies, and corporations, and jury assess. It all goes into the factor of how much someone may award.
