Question:

What are some common mistakes people make in their car accident cases?

Answer:

Common Mistakes in a Car Accident CaseThere are many common mistakes we see people make that can ruin their car accident case in Orlando. One of the biggest mistakes we see people make is hiring the wrong lawyer or law firm. If you hire the wrong lawyer or law firm, that can greatly diminish your chances of recovery, decrease the amount that you’re going to recover, and that’s one of the biggest mistakes we see people make. It’s important to hire the right lawyer and right law firm in your case.

Another huge mistake we see people make is waiting too long to seek medical treatment. Many times, people try to tough it out or don’t seek medical treatment right away, and that can damage the value of their case because, as the plaintiff, we have the burden of proof. The easiest way to start meeting that burden of proof and explain to the insurance company, corporation, or jury the nature of those injuries is through a doctor who has seen and evaluated our client and can document and memorialize exactly what’s going on.

Another big mistake we see people make is giving statements to insurance companies prior to speaking to a lawyer. Oftentimes, those insurance companies are taking those statements, recording them, and using them against you later on. We always recommend you do not speak to anyone— any insurance companies, any corporations – and especially don’t let them record it prior to consulting with a lawyer.

Another big mistake we see is people posting things on social media that may be used against them in their case later on. Social media is very popular, very easy to do, but oftentimes things that are put on there can be detrimental to a case later on. Another big mistake we see people make is failing to document the scene – especially like in a slip and fall case where someone may have slipped on a substance or something on the ground, that substance may get cleaned up rather quickly and there’s no documentation or photographs of exactly what they fell on. Hindsight is always 20/20, but we recommend if anyone ever has an incident like that to use their phone, take pictures, document exactly what is there. You may need that later on down the line.
